I reject the idea that this film should be considered a documentary. The rules clearly state that the film should have an emphasis on fact. Mr. Moore himself has admitted that this film was created using his own opinion.
Opinion is not fact it is Fiction.
Fact is not an opinion it is Non-Fiction.
fic·tion( P ) Pronunciation Key (fkshn) n.

represent actuality but has been invented.
b. The act of inventing such a creation or pretense.
2. A lie.
3. a. A literary work whose content is produced by the
imagination and is not necessarily based on fact.
b. The category of literature comprising works of this
kind, including novels and short stories.
Law. Something untrue that is intentionally represented
as true by the narrator.
I watched Mr. Moore admit his film was subject to his opinion. When asked about the facts his response was it's my opinion. How can a film be a documentary when opinions are what are being presented?
I keep hearing people say it is the highest grossing Documentary ever and I cringe everytime. Plain and simple this is not a 'Documentary'.
The following is the actual rules regarding an Academy Award for a Documentary.
Rule Twelve
Special Rules for The Documentary Awards

An eligible documentary film is defined as a theatrically released non-fiction motion picture dealing creatively with cultural, artistic, historical, social, scientific, economic or other subjects. It may be photographed in actual occurrence, or may employ partial re-enactment, stock footage, stills, animation, stop-motion or other techniques, as long as the emphasis is on fact and not on fiction.

Fahrenheit 9/11 is a film based on Mr. Moore's opinion, not on fact.
