Clear Channel Communications Inc. is set to file suit against Howard Stern and Infinity Broadcasting, according to a Reuters source. The suit will claim that the shock jock's racy programming was in breach of their zero tolerance policy for indecent antics over the air.
Clear Channel will reportedly file a $3 million countersuit to a $10 million lawsuit filed in federal court in Manhattan by Stern and Infinity Radio. According to Reuters, a source close to Clear Channel said the company felt it had to take Stern off the air because Stern would not provide any assurances that there would no be further breaches.
Stern has repeatedly accused Clear Channel of flip-flopping and playing politics, saying the company previously defended him against past indecency allegations until he became critical of President Bush.
Stern's suit claims that Clear Channel, the country's largest radio station owner, had broken its contract with him when they suddenly dumped his show from six Clear Channel stations following record breaking fines leveled against the Stern program by the Federal Communications Commission.
'Clear Channel are a bunch of cowards,' said Stern on his radio program this morning. 'They're the worst thing that ever happened to radio, as far as I'm concerned.'
This past month, Stern's radio program has returned to all six markets that Clear Channel had previously fired him from, including Rochester, Pittsburgh, and two Florida stations. He also picked up three more new markets, including another Florida station. Stern has not been shy about his desire to get Bush out of office, and wants to use the Florida stations to avoid another election night fiasco.
Spokesmen for Clear Channel, and Infinity have yet to comment.
